1. Acceptance of Terms

By creating an account, accessing, or using the Tagabantay application ("Platform", "App", "Service"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Tagabantay ("Company", "we", "us", "our"). If you do not agree to these Terms, you must not use the Platform.

2. Description of Service

Tagabantay is an online platform that connects families and individuals ("Hirers") seeking caregiving services with qualified caregiving professionals ("Providers" or "Caregivers") in the Philippines. The Platform facilitates job posting, application, matching, digital contracts, and payment coordination. Tagabantay acts solely as an intermediary and is not a direct employer of any caregiver listed on the Platform.

3. Eligibility

• You must be at least 18 years old to use this Platform.
• You must be a resident of or operating within the Philippines, or have the legal capacity to enter into a binding contract under Philippine law.
• You must provide accurate and complete registration information.
• You may not create more than one account per person or entity.
• Accounts that are suspended or terminated by Tagabantay may not be re-registered.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately at info@tagabantay.com of any unauthorized access or breach. Tagabantay shall not be liable for any loss resulting from unauthorized use of your account.

5. Hirer Responsibilities

• Hirers must post honest, accurate, and complete job descriptions.
• Hirers must treat caregivers with dignity and respect in accordance with Philippine labor standards.
• Hirers are responsible for confirming a caregiver's suitability for the specific care needs of the household.
• Payment obligations agreed upon through the Platform must be honored in full and on time.
• Hirers must not engage caregivers for activities outside the agreed scope of work.

6. Provider (Caregiver) Responsibilities

• Providers must submit truthful credentials, clearances, and professional information during registration and verification.
• Providers must fulfill accepted job commitments punctually and professionally.
• No-shows or late cancellations within the penalty window may result in violation records and potential suspension.
• Providers must not solicit hirers to transact outside the Platform.
• Providers consent to background verification including NBI Clearance, Police Clearance, and Barangay Clearance as required by Tagabantay.

7. Digital Contracts

Digital contracts created through the Platform are binding agreements between Hirers and Providers. Both parties must fully sign the contract before any job begins. Tagabantay provides the contract framework but is not a party to the contract and accepts no liability for non-performance by either party.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose under Philippine law.
• Submit false, misleading, or fraudulent information.
• Harass, threaten, or abuse any other user.
• Use the Platform to engage in human trafficking, abuse, exploitation, or any form of illegal labor practice.
• Circumvent any technical measure designed to protect the Platform or its users.
• Scrape, copy, or redistribute Platform content without authorization.

9. Payment and Fees

Tagabantay may charge platform fees for job postings or transactions as communicated through the Paywall system. All fees are clearly disclosed prior to submission. Tagabantay reserves the right to modify fees with reasonable prior notice. Refund disputes are subject to admin review and resolution.

10. Violations and Account Suspension

Tagabantay may issue warnings, suspend, or permanently terminate accounts for violations of these Terms, Philippine law, or platform policies. Repeated violations, misconduct, or fraudulent behavior may result in permanent removal from the Platform and reporting to relevant authorities where applicable.

11. Limitation of Liability

Tagabantay is a technology platform and is not responsible for the conduct, actions, or omissions of any Hirer or Provider. We do not guarantee the accuracy of user-submitted information, the quality of caregiving services, or the outcome of any engagement made through the Platform. To the extent permitted by Philippine law, Tagabantay's liability is limited to the amount of fees paid in the relevant transaction.

12. Intellectual Property

All content, branding, logos, trademarks, and software on the Tagabantay Platform are owned by or licensed to Tagabantay and are protected under Philippine intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

13. Amendments

We reserve the right to amend these Terms at any time. We will notify users of material changes via in-app notification or email. Continued use of the Platform after notification constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be resolved through proper legal channels in the Philippines, including mediation or the appropriate courts.
